Thomas was shot thru the chest by his brother, Charles while playing Yankee and Rebel. Charles had a gun which was supposedly unloaded. Thomas Hervey said "Shoot me. I'm a Yankee!" Young Charles, about 4 years old, pointed the gun and pulled the trigger. The gun fired and killed Thomas.
